Dear fellow Landowner, 

I’m reaching out as a fellow Texas landowner along the proposed DeLa Express pipeline route. I know it’s not always easy to keep up with what’s happening around the proposed pipeline, so I wanted to share where things stand, not as a lawyer, not with an agenda – just someone in the same situation as you – someone who wants to protect my property rights and protect my family. 

First, this pipeline is different from other pipeline projects – this is not a pipeline to bring energy to people’s homes. This is a pipeline to bring chemicals to a plastics refinery plant that would then be exported to places like China. 

The contents of the pipeline being transported are highly flammable and are known to cause cancer and respiratory issues. To make matters worse, the company behind the project, Moss Lake Partners, has never built, operated, or maintained a pipeline before. 

Putting my family’s health and safety into the hands of an inexperienced corporation is not a risk I want to take. I also firmly believe a private corporation should not be able to use eminent domain for private gain. There is nothing public about this pipeline – it is not helping add American energy to our grid. It is a pipeline to line a corporation’s pockets.

The company may have already started contacting you about surveying the property or even made an easement offer. 

Before you agree to anything, you should know: 

You are under no obligation to let them survey your property. They have no authority to force you into allowing a survey. There is NO LAW that says you have to let them on your property. You can say NO.

● You do not have to sign an easement agreement. They do not have eminent domain rights at this time, so the power is in your hands. No matter what their land agent says, you have the power not them.

● The proposed project is still in the early stages. The company has not even submitted a permit application to the Federal Energy Regulatory Commission – meaning there is no rush for you to make any decisions right now. 

A group of landowners has connected through the group called the Texas Easement Action Alliance, which is bringing folks together to make sure no one gets pressured or misled. They have used this type of landowner group in other states to make sure landowners’ rights are represented first and foremost.

We’re hosting a Zoom meeting so you can learn more about your property rights, what the company can and can’t do, what this pipeline project is about and what to expect over the coming months. We want to share important, practical information with fellow landowners so you have everything you need to make an informed decision.
